Are Trusts Always the Answer?
Estate planning can involve using trusts – either for lifetime transfers or for property inherited at death. But if the children are all adults and generally responsible, clients may question whether a trust is really necessary, and the estate planner could easily agree. However, the planner shouldn’t be so quick to cast the idea of trusts aside, for good reason.
In this Masterclass webinar, Jonathan Blattmachr will focus on one of his favorite topics: putting it all in trust. As he often says, “you can’t get toothpaste back into the tube,” and that analogy applies perfectly to trusts.
The asset protection – from creditors and predators – available to beneficiaries of a trust is unmatched. Once assets are in the hands of a beneficiary individually, with no restrictions, they are subject to creditor attachment, waste, imprudent investments, undue influence from bad actors, and more.
Jonathan will be joined by attorney Teresa Bush to discuss this topic and debate whether trusts are indeed always the answer. They will cover the list of benefits provided by even a simple trust structure where the beneficiary can serve as trustee and compare those benefits to what would happen with an outright gift. They will also recommend drafting strategies that can make trusts more palatable and provide guidance on how to discuss this issue with clients so they fully understand what they could lose by leaving property outright.
